Record Incoming & Outgoing Calls

Post by kola »

Hi,

I have a suggestion to make, if it could be made possible to record incoming & outgoing calls.

I know this feature is already in eyebeam softphone, but is their anyway you can incorporate it
at your end.

When we login to our account, we can actually see all the conversations & just click on the one,
we need to listen.

Thanks

Kola

Currently this is an option in the Fibernetics IP-PBX but I don't believe it will be coming to freephoneline anytime soon.
The server space required for this would be substantial and as a free service it wouldn't be a good investment for us when the money could go elsewhere.

I'll stick the suggestion into my superiors though!

This is actually a bylaw offence if you do not notify them prior to the call is connected.

How did I forget that..
Yes, it is also illegal to record a call without informing both parties involved. We won't be able to provide this feature because of this reason (I completely forgot that in my previous post)

Actually it's legal to record a call in Canada if only ONE party knows it's being recorded. It's not legal in some US states where both parties must be informed.

Well, yes it would be pointless to notify yourself that anything you say will be recorded ;)

What I mean by "both parties" is conference calls etc...

OUTGOING: Would be hard, since there would need to be a time lag where our system would say "This call is being recorded *blah blah blah".
INCOMING: Would be easy, just like our call centre does when you are finished selecting your queues.

Your right to a point. It is legal to record a telephone conversation but the law states that you must inform the other party that a recording will take place. The basis for this requirement is should the conversation become evidence in a trial proceeding it can be entered into evidence, however if you do not inform the other party it cannot.

Can you add a Call Recording feature to Freephoneline Desktop App, since its available in most other similar apps? Any party would record the call if desired on their local PCs, so they will be responsible for other party notifications if at all required, but not FFL network. Besides, your servers won't be used at all to store call recordings, so no extra costs involved.

While customers talk about it for 5 long years here as a prospective "innovation", and discuss "would be" legal restriction without knowing them, its in fact long forgotten feature of just about every softphone, except FFL one. Own conversation recording is allowed for personal log without any restrictions, and whether the other party was notified is checked ONLY if its used in legal proceedings to figure out if its admissible as evidence.

So its a shame you didn't offer Call Recording yet. Don't you think, FFL app must be updated periodically with new features added? Especially given the fact, you post ads in it without user permission, so its NOT free, but ad supported app, and the ads deliver more customers and generate ongoing profit for your company.

Because Fongo is an Canadian company, Fongo has to abide by Canadian law. Other VOIP providers are based in other countries, and their laws can be different concerning recording calls.

I might add, there are ways to record the sound coming from an audio device on a PC without concerning the Fongo service. You will likely get more fruitful results going that tack.

Canadian law allows to record a conversation if at least one party out of two is aware of the call being recorded. This can be the call originator. See Is it legal to record a private conversation? by Legaltree.ca. "One party consent exception to the rule against interception: any intended recipient of a communication is entitled to record it". Call recordings are legally prohibited only by a 3rd party, which is not participating in the call. In practice such 3rd party recordings are inadmissible in court if performed without a warrant. But call recordings made by participants of the conversation are legal in Canada, and based on the above legal article do not require notifying the other party on the call.

Besides, its obvious that FFL simply doesn't want to spend any funds on improving their app. The company is able to get a legal advice if they wanted to, and in fact such free advice is posted on the web by well qualified bodies, but FFL just abandoned the app development altogether long ago, while still using it to generate extra profit by ads.
